TIMING: The “Pop the Cherry” Sweepstakes (the “Promotion”) begins at 12:01 AM Central Standard Time (“CST”) on March 1, 2010 and ends upon official notification of the fifth and final sweepstakes prize (the “Promotion Period”).
HOW TO ENTER: To enter the Promotion, visit www.risquebiz.com (the “Website”) and register for membership (the “Registrant”) during the Promotion Period. Valid entry requires the creation of a Risquebiz.com membership profile complete with Full Name, username, valid e-mail address, and at least one personal photo. Photos must meet the Risquebiz.com membership photo guidelines.
Mail-in, telephone, or e-mail entries are not acceptable under any circumstance.
All sweepstakes entries become the property of Risquebiz Inc. and may be used by Risquebiz Inc. for any purpose and in any media campaign in perpetuity.
LIMIT ONE ENTRY PER PERSON PER E-MAIL ADDRESS (REGARDLESS OF WHETHER MORE THAN ONE PERSON USES THE SAME E-MAIL ADDRESS). MULTIPLE REGISTRATIONS BY THE SAME PERSON FROM DIFFERENT E-MAIL ADDRESSES IS NOT ALLOWED AND WILL IMMEDIATELY DISQUALIFY ANY REGISTRANT ATTEMPTING TO DO SO.
ELIGIBILITY: The Promotion is open only to legal residents of the United States (EXCLUDING PUERTO RICO), who are 18 years of age or over as of the date of entry (the “Entrant”).
Any individuals (including but not limited to employees, consultants, independent contractors, and interns) who have, within the past six months, performed services for Risquebiz Inc. or any organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the sweepstakes or supplying the prize, and/or their respective parent, subsidiary, affiliated and successor companies (the “Sweepstakes Entities”), and immediate family and household members of such individuals, are not eligible to enter or play. "Immediate family members" shall mean parents, stepparents, children, stepchildren, siblings, stepsiblings, or spouses. "Household members" shall mean people who share the same residence at least three months in one calendar year.
AGREEMENT TO THE OFFICIAL RULES: By participating in the Promotion, each entrant unconditionally agrees to and accepts these Official Rules, the Terms, and Privacy Policy, and the decisions of Risquebiz Inc. which are final and binding in all matters related to the Promotion. Wining a prize is contingent upon fulfilling all requirements set forth herein.
PRIZES: Five winners will each receive one (1) Acer Aspire One Netbook configured with 1 GB RAM and a 160 GB Hard Drive. Approximate total value of each prize is $299.00. There are no other prizes.
WINNER SELECTION AND NOTIFICATION: Each prize winner will be selected according to the date and time of Risquebiz.com registration and profile approval and whether they are the 1,000th, 10,000th, 100,000th, 1,000,000th, or 10,000,000th member. Profiles are approved on a first in, first out basis and must adhere to the Risquebiz.com profile guidelines. Risquebiz Inc. reserves the right to deny membership to any person without cause.
Winners will be contacted by telephone initially and confirmed in writing, and will be required to complete and return an Affidavit of Eligibility and Liability Release and, except where prohibited by law, a Publicity Release Form (“Affidavit/Release”) within seven (7) days of receipt. Failure to return required documentation within the required time period may result in disqualification and selection of an alternate winner. Except where prohibited by law, acceptance of a prize constitutes permission for Risquebiz Inc. to use Winner’s name, likeness, and statements for promotional, advertising and marketing purposes via any media world-wide without additional payment or consideration.
PRIZE CONDITIONS: No other substitute for the prize offered may be made, except at the sole discretion of Risquebiz Inc., who reserves the right to substitute a prize in whole or in part with another prize of comparable or grater value if the intended prize is not available or able to be awarded for any reason as determined by Risquebiz Inc. Winner will be responsible for all taxes (not limited to federal, state, local and/or income) on prize and will be required to provide his/her Social Security number for tax reporting purposes. A Misc. income for 1099 will be filed with the Internal Revenue Service for the fair market value of all prizes awarded.
GENERAL CONDITIONS: By participating, Entrants (a) release the Sweepstakes Entities, their respective directors, officers, agents and employees from any and all liability for any claims, costs, injuries, losses or damages of any kind caused by their participation, including the unauthorized or illegal access to personally identifiable or sensitive information or the acceptance, possession, use, or misuse of the prize(s) offered in the Promotion; and (b) acknowledge that said parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to a prize offered. Neither the Sweepstakes Entities nor any promotional or service providers are responsible for incorrect or inaccurate transcription of entry information, or for any human or other error, technical malfunctions, lost/delayed data or voice transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any online service or website or to complete a telephone call or facsimile transaction, or any other error or malfunction, or late, lost, or misdirected mail, or any injury or damage to participant's or any other person's computer related to or resulting from participation in this Promotion. In the event of a dispute, online entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an Internet access provider, on-line service provider, or other organization that is responsible for assigning email addresses or the domain associated with the submitted email address. Any potential winner may be required to show proof of being the authorized account holder.
CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE, TAMPER WITH THE ENTRY PROCESS, OR OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, RISQUEBIZ INC. RESERVES THE RIGHT TO COOPERATE IN THE PROSECUTION OF ANY SUCH INDIVIDUAL(S) AND TO PURSUE ALL REMEDIES TO THE FULLEST EXTENT PERMITTED BY LAW. Failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If for any reason the Promotion is not capable of being executed as planned, or infection by computer virus, bugs, tampering, unauthorized intervention, fraud, action of entrants, technical failures or any other causes which in the opinion of the Risquebiz Inc., corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Promotion, the Risquebiz Inc. reserves the right at its sole discretion to disqualify any suspect entry or entrant and to cancel, terminate, modify or suspend the Promotion. In the event of any cancellation, termination or suspension the determination of the Prize winner will be made, from among all eligible, non-suspect Entries received as of the date of the termination, cancellation or suspension. Entrants agree that (a) any and all disputes, claims and causes of action arising out of, or connected with, the Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the state of Louisiana (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participation in the Promotion but in no event attorneys' fees; and (c) under no circumstances will registrant be permitted to obtain awards for, and registrant hereby waives all rights to, claim punitive, incidental and consequential damages and any other damages, other than out-of-pocket expenses.
